Byerly Self Storage Rules and Regulations

I. RENT POLICY

  1. Rent is due and payable on or before the first day of the month.  No statements will be sent, unless requested.
  2. Rent is delinquent after the first.
  3. Rent not received in our office by the 7th will result in the Landlord overlocking the stall.
  4. Late payment fees and administrative charges are as follows:
    Dates Charges Accumulative Charges
    First Month After 7th $5.00 $5.00
    After 25th $5.00 $10.00
    Following Months After 7th $10.00 $20.00
    After 25th $10.00 $30.00
  5. Overlock will not be removed until ALL RENT LATE FEES AND ADMINISTRATIVE CHARGES are paid.
  6. Failure to pay your rent may result in your valuables being sold.
  7. A Fifteen Dollar ($25.00) Bad Check Charge will be assessed on any checks returned to us, Non-Sufficient Funds.
  8. A Five Dollar ($5.00) charge will be added per: Certified Letter sent to all accounts in arrears.
  9. When paying by check, please put your stall number on the check.

II. REFUND POLICY: RENT AND DEPOSIT

  1. Unused Rent is refunded only when:
  1. Tenant is current on all obligations
  2. Landlord is notified of Tenant's intent to vacate.
  3. Tenant has removed his or her lock from stall.

Security Deposit is refunded only when:

  1. Tenant is current on all obligations
  2. Stall is broom clean and all contents removed.
  3. Stall is not damaged.
  4. Tenant's Lock is removed

Allow 30 days for receipt of refunds.

III. ABANDONMENT:

  1. Storage Lease Agreement is automatically terminated if stall is abandoned.  Abandonment exists if tenant has:
  1. Removed contents and/or removed locking device, and failed to notify Landlord of vacated stall.
  2. Tenant is not current on obligations

IV. LEGAL ADDRESS:

  1. The Storage Lease Agreement defines the Tenant's Legal Address.  This address will remain the Tenant's legal address for the purpose of notification until the Tenant advises Landlord in writing of any change of address.  Such Changes must be:
  1. In writing, dated and signed by Tenant.
  2. Complete new address, zip code and telephone number

V. TENANT RESPONSIBILITIES

  1. Tenant must keep the stall locked with his or her own heavy-duty steel lock at all times, using only one hasp per door lock.
  2. All property stored is at Tenant's sole risk.  Landlord is not responsible for theft or damage to property caused by fire, water, wind, rain, storms, tornadoes, explosions, riots, rodents, civil disturbances, insects, vehicle or any other cause whatsoever, nor shall Landlord be held liable for personal injuries on the premises.
  3. Any insurance on contents will be provided by Tenant at said Tenant's sold discretion and expense.

VI.  HOURS OF OPERATION:

  1. Office Hours: 8:00 am to 5:00 pm Monday through Friday, Saturday 8:00 am to 12:00 pm. Closed Sundays and Holidays.
  2. Gate Hours: Twenty-four hours per day, 7 days per week access.  RANDOM POLICE AFTER OFFICE HOURS

VII.  STORAGE RULES

  1. The stall is to be used for the purpose of storage of personal property and for no other use.   The tenant shall not use the stall for:
  1. Storing living animals or carcasses
  2. Storing gasoline, explosives, paint, flammable chemicals, or other hazardous materials.
  3. Any use which constitutes full time shop facilities, office, or principal place of business
  4. Garage sale, flea market, or sale of any kind directly from the stall.
  5. Use of ceiling joists for lifting or supporting heavy objects
  6. Automobile repair for hire or full time.
  7. Absolutely NO food items, nor storage of any liquids in inadequate containers.
  8. Any tires left in stall after vacating said stall shall result in forfeiture of any refundable deposit and rent.
  9. It is NOT RECOMMENDED that articles of value, that could be damaged by absorption of moisture from the air or concrete floors, be stored.
  10. Please help conserve electricity by turning off the lights in your stall.
